Scope

These terms of use apply to the use of the platform www.parknsleep.app and constitute a legally binding contract between the user (host, camper) and parknsleep AG (hereinafter «Parkn’Sleep»), which governs the use of the websites and applications as well as other offerings of this platform.

These terms of use apply to all contracts concluded between you as a user and us as the operator of the platform.

Who we are

parknsleep AG is a Lucerne-based company founded in January 2021. Through intensive market analysis and workshops with authorities and decision-makers, we developed a product over around 18 months that reflects modern motorhome tourism. Our mission is to promote motorhome tourism in the tourist destination regions of Europe while at the same time involving the tourist destinations. Through the platform, we provide the technical means to involve all market participants fairly, to actively promote tourism and, in particular, to make the management of motorhome pitches attractive and secure.

1 The platform

Parkn’Sleep or parknsleep.app is an intermediary platform for motorhome pitches with parking characteristics. It differs fundamentally from booking platforms for camping offers:

Providers, so-called hosts, list their pitch on the platform. Unlike campsites or booking platforms, Parkn’Sleep pitches cannot be reserved in advance. However, they can be approached spontaneously at any time.

In our system, the availability of the individual spaces is shown on the respective pitch listing. Available spaces are marked on the map search with a green pin, limited spaces with a yellow pin and fully booked spaces with a red pin. The booking only takes place on site through the «Check-In» confirmation. The availability is not binding and is considered a forecast. Nevertheless, the host must ensure the availability of the spaces to the best of their knowledge and belief.

Parkn'Sleep gives no guarantee for inaccessible or unavailable spaces or for incorrect information provided by the host.

Pitch offers can be posted by municipalities, private individuals or legal entities. The hosts and the listed pitches must meet the relevant requirements.

2 Use for campers

The web app www.parknsleep.app is free of charge and can be used to search for official pitches. Listed pitches can be approached at any time with the intention to book and without registration. Registration (surname, first name, vehicle registration number and payment details) is only required immediately before the first booking (check-in). Payment data is transmitted in encrypted form and is not stored locally. Personal details remain stored in the customer account. More on this in the privacy policy.

The booking takes place during the check-in process. Once the camper has arrived at a Parkn’Sleep pitch, they can secure an individual space by checking in their vehicle with a swipe gesture and confirming the booking.

Payment is made automatically to the relevant parties upon booking. The host receives the overnight fee and the municipality, if agreed, the tourist tax.

If a camper is not aware of Parkn’Sleep on arrival, they can start the process by scanning the QR code of the Check-in Point on site.

The overnight fee is shown in the pitch listing as a total amount. Any tourist tax is shown separately below the total amount.

3 Use for hosts

Hosts are municipalities, private individuals or legal entities that make pitches available to motorhome travellers on the platform. They meet the relevant requirements to be able to list a pitch on Parkn’Sleep. The listed pitch also meets the relevant requirements.

Pitches can be listed free of charge on the platform www.parknsleep.app. There is no contractual commitment, no subscription fees and no minimum terms. The listing can be deactivated or paused at any time. The service is provided between host and camper.

4 Fees

Hosts (B2C)

Parkn'Sleep charges hosts a platform fee of 15% on the overnight price. This includes all host-specific services such as payment infrastructure, signage, invoicing, collection protection and platform operating costs.

Campers (B2C)

Parkn'Sleep charges campers a platform and environmental fee of 15% on the overnight price. This includes all user-specific services such as the digital reception, marketing, product development, operating costs and active participation in the form of donations to environmental organisations specialising in plastic clean-up. We do not support CO2 offsetting programmes.

Example: The overnight price set by the host is CHF 20.00. The total price shown to the camper is CHF 23.00. Of this, Parkn'Sleep receives CHF 6.00 platform fee (15% from the host / 15% from the camper). The host is credited CHF 17.00 to their payout account.

Tourism levies (municipalities / tourist offices)

The tourism levy can be claimed by the responsible organisations. Settlement is handled automatically via Parkn'Sleep. The camper states the number of persons in the vehicle at check-in. The overnight stays are added to the total price.

Example: Municipality XY charges CHF 1.50 per overnight stay. The overnight price set by the host for a space in this municipality is CHF 20.00. Mr and Mrs Müller check in and state 2 persons. The total price shown to the camper is therefore CHF 26.00. Of this, Parkn'Sleep receives CHF 6.00 platform fee (15% from the host / 15% from the camper), the municipality receives CHF 3.00 (2 persons at CHF 1.50) tourism levy and the host receives CHF 17.00 in their payout account.

5 Use for existing motorhome pitches

Parkn’Sleep can be implemented free of charge as a payment system for existing motorhome pitches. To do so, providers simply register as a host and add their site. Use as a secondary system, e.g. alongside existing parking meters, parking management systems, directories or booking platforms, is possible at any time without additional effort.

6 Responsibilities of users and hosts

You are responsible for your own acts and omissions and also for the acts and omissions of persons whom you invite to join the booking of a motorhome pitch or to whom you grant access to it. This means, for example: (i) you are responsible for leaving a pitch (and related personal property) in the condition in which you found it, and (ii) you must always act with integrity, treat others with respect and comply with applicable laws. If you book for an additional guest who is a minor, or if you are accompanied by a minor, you must be legally authorised to act on behalf of the minor, and you alone are responsible for supervising that minor.

7 Check-in Point

The Check-in Point signals the pitch to arriving campers. Every host receives one welcome set free of charge. It contains a sign (A5). The Check-in Points are equipped with an individual QR code. A scan leads directly to the check-in area of the respective pitch.

The Check-in Points are sent out as soon as a new pitch is registered and has been reviewed and approved by us.

Special and larger signage is discussed individually with the hosts and produced by us.

8 Rental relationship and contracts with campers

The contractual relationship (including the rental agreement) arises between host and camper for the purpose of using the pitch listed by the host. parknsleep AG is merely an intermediary and not a party to the rental agreement.

When the camper confirms the booking (check-in), the rental agreement is concluded automatically and without further consent from the host.

The contractual relationship includes the conditions and services listed in the listing at the time of booking. When you confirm a booking request or receive a booking confirmation, you enter into a contract directly with the camper and are responsible for providing the service under the conditions and at the price stated in your listing. You are also responsible for paying all applicable fees (and applicable taxes) for each booking. All terms or conditions that you include in any additional agreement with guests must: (i) be consistent with these terms of use, our policies and the information provided in your listing and (ii) be clearly stated in your listing description.

The contractual relationship ends with the termination of the booking (manual check-out process).

9 Platform rules

You must follow these rules and must not help or induce others to break or circumvent them. The following applies:

  • Act with integrity and treat others with respect.
  • The platform must not be damaged, hacked, reverse-engineered, compromised or impaired.
  • Use the platform only as authorised by these terms of use or another agreement with us.
  • Fulfil your legal obligations.

10 Checks on pitches

To ensure fair use of the pitches, Parkn'Sleep carries out spot checks at irregular intervals. These check whether vehicles are correctly checked in via the platform. In the event of unauthorised use (parking without paying), a surcharge of CHF 80.– and, where applicable, a supplement for the inspection effort become due.

In the event of a check, payments via alternative systems must be evidenced by a valid proof of payment. The checks are carried out in compliance with Swiss legislation and with the consent of the hosts.

11 Liability

All rights and obligations arising from the contractual relationship for the use of pitches arise exclusively between host and camper. Hosts provide the services offered to the camper solely on their own responsibility. Only campers are liable to the hosts for the contractual use of the pitch.

parknsleep AG declines all liability and warranty for claims resulting from the rental agreement.

Otherwise, Parkn’Sleep is liable in accordance with the statutory provisions for intent and gross negligence. The same applies to the assumption of guarantees or any other strict liability, or in the event of culpable injury to life, body or health. In the event of slightly negligent breaches of material contractual obligations by us, liability is limited to the typically occurring foreseeable damage.

Any further liability of Parkn’Sleep is excluded.

12 Reporting violations

If you believe that a user, a listing or its content poses an imminent risk to a person or pitch, contact the local authorities immediately before contacting Parkn’Sleep. If you also believe that a member, listing or content violates our standards, you should report your concerns to Parkn’Sleep. If you have reported a problem to the local authorities, Parkn’Sleep may request a copy of that report.

13 Termination, suspension and other measures

The contract between you and Parkn’Sleep, as reflected in these terms of use, remains in force until either you or we terminate the contract in accordance with these terms of use.

You can terminate this contract at any time by sending us an email requesting that your user account be deleted. Parkn’Sleep can terminate this contract at any time with 30 days' notice by email or using any other contact details you have provided for your user account.

Parkn'Sleep may also terminate this contract with immediate effect and without prior notice and stop providing access to the platform if (i) you materially breach your obligations under these terms of use or our policies, or (ii) you violate applicable law.

14 Purchase and use of vouchers and credit

Vouchers and credit can be purchased on the Parkn’Sleep website and can only be redeemed for overnight stays on Parkn’Sleep pitches.

After purchase, they can be used as a means of payment.

Responsibility for the vouchers and credit lies with the owner. They cannot be refunded, returned or paid out in cash. The balance can be used for full or partial payments. A cash payout of the remaining credit is not possible.

Under Swiss law, a voucher or credit remains valid for 10 years. If a voucher or credit is not used within this period, the credit expires.

You can find the terms of use for the Camper Card Unlimited here.

15 Applicable law and place of jurisdiction

These terms of use are governed by Swiss law. If you are a consumer and mandatory statutory consumer protection provisions of your country of residence contain provisions more favourable to you, these provisions apply irrespective of the choice of Swiss law. As a consumer, you can assert claims in connection with these terms of use both before the competent court at your place of residence and before the competent court at the registered office of Parkn’Sleep in Switzerland. If Parkn’Sleep wishes to enforce its rights against you as a consumer, we can only do so before the competent courts at your place of residence. If you act as a business, you agree to submit to the exclusive jurisdiction of the Swiss courts at the registered office of Parkn’Sleep.
