How we process and protect your data.
This privacy policy (the “Policy”) describes our policies regarding the collection, use and disclosure of personal information of the Parknsleep platform (the “Platform”), accessible at https://www.parknsleep.app, operated by parknsleep AG (“us”, “we” or “our”), as well as the various marketing activities (website parknsleep.eu, offline activities, social media, email messages in HTML format, collectively “Channels”).
References and links to third-party websites are outside our area of responsibility. Any responsibility for such websites is declined. Access to and use of such websites is at the user's own risk.
By personal data we mean data that can be used to establish your identity. This includes, for example, your name or your email address.
Non-personal data, on the other hand, is information that cannot be clearly linked to you, such as the number of visitors to a website.
When you interact with the Channels, we may collect personal data. This includes, among other things:
When you register on our Platform and use it, we collect additional personal data. This data includes, among other things:
In order to ensure a high level of security and optimal use of our Channels and to optimise their availability, we store selected usage data of visitors when they access the Channels. This usage data is not evaluated to create personal usage profiles.
Usage data includes, among other things:
Occasionally we link usage data with personal data, e.g. an exact geographical location with your name. If we link usage data with personal data, we treat the linked data as personal data.
We use the personal data you share with us for the following purposes:
Unless otherwise provided by applicable laws, we may use, transfer and disclose other data we collect for any purpose. If we are required by applicable laws to treat other data as personal data, we will use and disclose it exclusively in the same way as personal data.
The use of automated interactions by the Platform may change as technology evolves. The following describes in more detail how the Platform currently uses the data collected during automated interactions.
When you visit websites or read HTML emails, information is automatically transmitted from you for technical reasons when the connection is established. This is mostly information about network access (where you are accessing from), the device (hardware and browser or email client), your IP address (which allows conclusions to be drawn about geographical location and company) as well as date and time.
On our website we use standard market techniques such as cookies or tracking pixels (invisible graphics). They serve to make our website user-friendly, effective and secure. Cookies are small text files that are stored locally in the cache of the website user's internet browser and enable the browser concerned to be recognised. In addition to so-called session cookies, which are deleted automatically as soon as you log out or close your browser, we also use so-called permanent cookies, for example for the “Stay logged in on this computer” function, which recognise a returning user. Our cookies do not cause any damage to your computer.
You can prevent the installation of cookies by adjusting your browser software settings accordingly. Of course, you can delete cookies at any time using the corresponding browser function. If you delete cookies or set your browser to reject cookies, this may impair the functionality of the website.
We may use personalised or embedded URLs that allow us to identify you even without cookies. When an obviously personalised or embedded URL is used, personal data may be collected as you navigate through our website.
We may use embedded pixel technologies in the electronic Channels that serve to identify individual user visits (as opposed to total visits) or for advertising purposes. Embedded pixels or other technologies may also be used in emails and online advertising. In this case, they provide information about when an email or advertisement was opened and how effective marketing campaigns are. The data collected with these technologies may be linked to the recipient's email address.
Within the framework of contractual and other legal relationships, on the basis of legal obligations or otherwise on the basis of our legitimate interests, we use functions of the payment service provider Stripe. The provider is Stripe Inc., 510 Townsend Street, San Francisco, CA 94103, USA.
The data processed by the payment service providers includes personal data, such as name and address, bank data, such as account numbers or credit card numbers, as well as contract, amount and recipient-related information. Verification by Stripe Connect is established by uploading an identity document (ID). The information is required to carry out the transactions. However, the data entered is only processed by the payment service providers and stored with them. This means that we do not receive any account or credit card information, but only information confirming or rejecting the payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit agencies. The purpose of this transmission is to check identity and creditworthiness. In this regard, we refer to the terms and conditions and privacy notices of the payment service providers.
The terms and conditions and privacy notices of the respective payment service providers, which can be accessed within the respective websites or transaction applications, apply to the payment transactions. We also refer to these for further information and for asserting rights of revocation, information and other data subject rights.
Further information can be found in Stripe's privacy policy: https://stripe.com/privacy.
What types of cookies we use:
We use Google Tag Manager on our website. This service allows website tags to be managed via an interface. Google Tag Manager only implements tags. No cookies are set and no personal data is collected. Google Tag Manager triggers other tags, which may collect data. Google Tag Manager does not access this data. If deactivation has been carried out at domain or cookie level, it remains in place for all tracking tags insofar as these are implemented with Google Tag Manager. More information about Google Tag Manager can be found at the following link: http://www.google.de/tagmanager/use-policy.html
The user has the option of preventing all Google Tag Manager tags from being sent. To do this, the user must click the following opt-out link in order to place the Google Tag Manager deactivation cookie in their browser.
Our Platform uses functions of the web analytics service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics also uses cookies. These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is generally transmitted to a Google server in the USA and stored there. Google Analytics cookies are stored on the basis of Art. 6(1)(f) GDPR.
We use functions of the Posthog service on our Platform. These functions are provided by Posthog Inc., 965 Mission Street, San Francisco, CA 94103 USA. We use functions of the Mailchimp service on our Platform. These functions are provided by The Rocket Science Group LLC d/b/a Mailchimp, Attn. Privacy Officer, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.
The Platform's newsletters and press releases are sent with the newsletter program Mailchimp. An email address is registered for the newsletter and press release mailing via the opt-in procedure. Each email sent contains a link with which the recipient can unsubscribe from the newsletter list.
The email addresses of our newsletter subscribers and, where applicable, their first and last names are stored on Mailchimp servers in the USA. Mailchimp uses this information on our behalf to send and evaluate the newsletters. Mailchimp may use this data to optimise its own services. However, Mailchimp does not write to the recipients on its own initiative. Your data may also be passed on to third parties to fulfil the stated purposes. Mailchimp also reserves the right to pass on your data for advertising purposes in cooperation with advertising networks and social media.
The emails are sent via various servers in Europe (and, in exceptional cases, in the USA). Among other things, the following data is collected from these emails, stored in the USA and made available to consumer protection as reports: bounce rates, open rates and click rates.
Further information can be found in Mailchimp's privacy policy: http://mailchimp.com/legal/privacy/.
On request, we will inform you at any time which data about you is stored by us. Should incorrect information be stored by us despite our efforts to keep your data accurate, complete and up to date, we will correct it immediately at your request.
The criterion for the duration of storage of personal data is the respective statutory retention period. After expiry of this period, the corresponding data is routinely deleted, provided it is no longer required for the performance or initiation of a contract.
In accordance with Art. 32(1) EU GDPR, we use technical and organisational measures for security in the processing of data in order to protect personal data against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. The security measures in use are regularly reviewed and improved in line with technological developments.
Persons who have not yet reached the age of 16 may not transmit any personal data to us without the consent of their legal guardians. Persons who have not yet reached the age of 16 may only provide us with personal information if the express consent of their legal guardians has been given or if the persons have reached the age of 16 or are older. This data is processed in accordance with these policies.
If we process data in a third country (i.e. outside the European Union (EU) or a country recognised by the EU as a safe third country with adequacy status), or if this occurs in the context of using third-party services or disclosing or transmitting data to third parties, this only takes place if it is done to fulfil our (pre-)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of our legitimate interests. Subject to statutory or contractual permissions, we process or have the data processed in a third country only if the special requirements of Art. 44 et seq. GDPR are met. This means that processing takes place, for example, on the basis of special guarantees, such as the officially recognised determination of a level of data protection corresponding to that of the EU (e.g. for the USA through the “Privacy Shield”) or compliance with officially recognised special contractual obligations (so-called “standard contractual clauses”).
We ask you not to send or pass on to us any confidential personal data (e.g. social security numbers, information on race or ethnic origin, political opinions, religious or other beliefs, health, criminal record or trade union membership).
